C'\u00e9tait en fait la deuxi\u00e8me fois qu'elle se promenait sans haut dans la ville de Guelph par une temp\u00e9rature de 33\u00b0C. La premi\u00e8re fois n'avait suscit\u00e9 que des r\u00e9actions perplexes. La premi\u00e8re promenade n'a suscit\u00e9 que des r\u00e9actions perplexes. Mais le deuxi\u00e8me jour, elle s'est heurt\u00e9e \u00e0 plus d'opposition lorsqu'elle s'est arr\u00eat\u00e9e pour parler dans la rue Ontario. Une certaine Mme Pettifer a appel\u00e9 la police apr\u00e8s que Gwen Jacob eut refus\u00e9 sa demande de se couvrir. Une autre habitante de cette rue, Mme Snarr, s'est inqui\u00e9t\u00e9e de l'impact que les seins nus auraient sur ses jeunes enfants. La police a demand\u00e9 \u00e0 Gwen Jacob de mettre sa chemise. Ils l'ont arr\u00eat\u00e9e lorsqu'elle a refus\u00e9 et l'ont accus\u00e9e d'avoir commis un acte ind\u00e9cent.<\/p>\n

Lors du premier proc\u00e8s en 1991, Mme Pettifer a d\u00e9clar\u00e9 que les seins nus \u00e9taient \"d\u00e9go\u00fbtants\", tandis que Mme Snarr a affirm\u00e9 qu'il \u00e9tait \"sale\" pour les femmes d'exposer leurs seins. Gwen Jacob a \u00e9t\u00e9 reconnue coupable et condamn\u00e9e \u00e0 une amende de $75. En 1992, la Division g\u00e9n\u00e9rale de la Cour de l'Ontario a confirm\u00e9 le jugement.
